Score one for consumers in the poultry false advertising cases! The Courthouse News Service, among others, reported on the win for consumers in Cohen v. Conagra. I argued this case in September and the Ninth Circuit Court of Appeals ruled in under two months to send the case back to the trial court. This week my team and I filed a consumer class action against Diestel Turkey Ranch in federal court in New Mexico for deceiving consumers. Diestel’s own documents show that less than 1% of the birds it raises and sells match the way it has advertised the turkeys. The undercover video and Diestel’s own vet records are evidence that birds in Diestel’s care do not live the life that Diestel promises consumers.
